Each of the parties listed above (each, a “member” and, collectively, the “members”) and Dallas Swim Club Royal LLC (d/b/a Club Royal Pool), a Texas limited liability company together with all of its successors and assigns (collectively, the “Pool Company”), do hereby agree that, in exchange for member having the right to participate in the activities of swimming, sunbathing, and playing at the pool (the “pool”) located at 3433 Townsend Drive, Dallas, Texas 75229, each members agrees for itself and (if applicable) each of the other members of my family listed above, to the following:
1. GATE, GATE CODE, AND SIGNING IN:
The pool is for paying members and their (signed-in) guests only. All members will be issued a new gate code at the beginning of each month, via email. DO NOT give your gate code out to anyone, ever.
The CRP front gate must remain closed and locked at all times. Always close the gate behind you when entering or leaving the pool. The gate may not close automatically. The lock will automatically SELF-LOCK within 30 seconds.
Always sign in using the sign-in device located at the entrance to the pool, indicating the number of members, the number of guests for this visit and any other information required on the sign-in sheet.
2. CHILDREN AND GUESTS:
Children under the age of 14 must be accompanied by an adult at all times.
Children in diapers are required to wear “Little Swimmers” or other similar swim diapers when in the pool. NO REGULAR DIAPERS ARE ALLOWED. Should there be an accident, please let the on-site staff know and contact a board member immediately.
The inviting member must accompany guests at all times. Guests are limited to five (5) people per membership at any given time. Fees are required for all guests, there are no free guests. Guest fees are $5 per person per visit and must be paid by the member at the time of the visit. Payment options include via the Square app at the pool, www.clubroyalpool.org, or by cash. If paying by cash, write the member’s name and the number of guests on an envelope (available near the sign-in sheet), enclose the payment, seal the envelope, and insert it in the slot inside the small window. The QR code for payment options is available at the sign-in desk.
For larger groups of guests (6+), please go through the event reservation page at www.clubroyalpool.org for party reservations and fees. Each membership is permitted to have only 1 party per month.
3. LIFEGUARDS:
PLEASE BE WARNED THAT THERE IS NO LIFEGUARD ON DUTY REGULARLY AND ALL MEMBERS, GUESTS AND OTHER PARTIES ARE SWIMMING AT THEIR OWN RISK. You are responsible for watching your children at all times. The Pool Company may have lifeguard(s) for parties, large events, most weekends, and limited hours during the week but no such lifeguards are required. When a lifeguard is on duty, he/she will take a 10-minute break each hour. Anyone under 14 will be required to leave the pool during the breaks.
Lifeguards are charged with maintaining a safe environment at Club Royal Pool. This means they will correct children as well as adults who are not complying with the pool rules or behaving in an unsafe manner. It is their job to do so. Please treat them with respect. Harassing or abusive behavior toward the lifeguards will not be tolerated and may be grounds for revocation of membership with no refund.
No one is allowed on the lifeguard stand except the lifeguard.
4. POOL HOURS AND IN-THE-POOL RULES:
Pool hours are 8 a.m. to 9 p.m. Sunday through Thursday and 8 a.m. to 10 p.m. Friday and Saturday.
Please shower or rinse off before entering the pool.
Proper swimwear must be worn in the pool – no cut-offs or street clothing.
Non-swimmers with flotation devices (including life jackets, arm wings, and inflatable rings) must be accompanied by an adult at all times whether in the shallow or deep end of the pool.
Large floats or rafts may not be used in the deep end. Lifeguards may ask that multiple large items be removed from the pool if those items hamper the lifeguards’ ability to see swimmers.
Do not sit or hang onto the pool safety rope.
Diving is permitted only in the deep end of the pool.
The diving board is only permitted to be used when there are 2 or more lifeguards on duty. During all other periods, the diving board will be chained off and locked with a sign and no diving will be permitted. Members and guests are not permitted to remove the sign or chain. When the diving board is open, only 1 person at a time is allowed on the diving board. The next swimmer must wait to leave the diving board until the previous swimmer has reached the side of the pool. Hanging off the diving board is never permitted.
5. GENERAL RULES:
NO GLASS CONTAINERS are allowed inside the pool enclosure.
Pets are not allowed inside the pool enclosure.
Eating is not allowed in the pool or while sitting on the edge of the pool.
Horseplay, pushing, shoving, running, and chasing are not allowed.
Smoking/vaping is not permitted in or near the pool. Smoking is permitted at your table, away from common areas; provided, that an ash tray or other safe container is used to dispose of any ashes.
Members who bring their own speakers for music must keep the volume at a level for their table only. Music selections may not be vulgar or profane.
All members must clean up after themselves. This includes picking up trash, wrappers, pool accessories, etc. A receptacle is provided for recycling aluminum cans and a recycling bin is provided for other recyclables. (Pizza cartons are not recyclable unless they are clean and grease-free.)
If chairs or lounges are moved, put them back in their original positions before leaving the pool. Chairs, lounges, and tables have specific uses and should only be used for such uses. Please do not allow anyone to stand, climb or jump on any chairs, lounges or tables.
Grills are available for us at your own risk. Do not move grills. Clean grills as well as any CRP grill tools completely after use and empty the grease pan. Do not put meat scraps or bones in the CRP trash cans. Take that trash home to dispose of it.
Lower the umbrella when you vacate a table.
Do not touch, plug, or unplug the aerator (sprayer). It is used only when it is necessary to cool the water temperature.
6. EMERGENCIES:
There is a 911 emergency-only phone. Do not touch or use unless you have a legitimate emergency. The fine for a false 911 call can be up to $2500. Make sure children know not to touch the phone unless it is for an emergency.
7. AGREEMENT TO FOLLOW DIRECTIONS.
I agree to observe and obey all posted rules and warnings, including those stated in this Membership Agreement, and further agree to follow any oral instructions or directions given by the Pool Company, or the employees, representatives or agents of the Pool Company.
8. ASSUMPTION OF THE RISKS AND RELEASE.
I further certify that I am in good health and have no physical or other impediment which would endanger me while participating in the activities permitted at the pool. I will not be under the influence of drugs or alcohol, which would impair my ability. I acknowledge and agree this activity has inherent risks. I have full knowledge of the nature and extent of all the risks associated with this activity.
In consideration of my participation in this activity, I agree (on behalf of myself, my heirs, executors, administrators, and assigns) to release, discharge, waive and relinquish the Pool Company and its officers, board members, agents, employees, owners, members, managers, successors and assigns from any and all liabilities, claims, or actions for personal injury, property damage, or wrongful death which may arise out of my participation.
My use of the pool facilities during my stay involves certain risks, including but not limited to:
1. The risk of injury resulting from possible malfunction of the pool equipment;
2. The risk of injuries resulting from tripping or falling over obstacles in the pool area;
3. The risk of injuries resulting from unsupervised divers and swimmers colliding;
4. The risk of other injuries resulting from participating in any action in the pool.
I recognize and fully understand that the above list is not a complete or exhaustive list of all possible risks; the list only provides examples of types of risks that I am assuming.

9. INDEMNIFICATION; WAIVER, ETC.
In exchange for the Pool Company allowing me to utilize the pool and associated areas during my visit, each member hereby agrees to the additional conditions set forth below:
I agree to waive any and all claims that I have or may have in the future against the Pool Company and its officers, board members, agents, employees, owners, members, managers, successors and assigns relating to my use of the pool and the facilities of the Pool Company.
I agree to release the Pool Company and its officers, board members, agents, employees, owners, members, managers, successors and assigns from any and all liability for any loss, damage, injury, expense or other cost that we may suffer or that any Child or any guest may suffer in connection with our use of the pool or facilities to any cause whatsoever, including negligence or willful misconduct of any member or guest.
I agree to indemnify, defend and hold harmless the Pool Company and its officers, board members, agents, employees, owners, members, managers, successors and assigns against all claims, cause of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or the members’ or any of my guests’ use of or presence upon the facilities of the Pool Company.
These provisions are fully effective and shall be effective and binding upon me, my heirs, next of kin, executors and administrators or anyone else authorized to act on my behalf or on behalf of my estate.
10. FEES.
I agree to pay for all damages to the facilities of the Pool Company caused by the members’ use of the Pool Company’s facilities, including any negligent, reckless, or willful actions by me or my family.
11. APPLICABLE LAW.
Any legal or equitable claim that may arise from participation in the above shall be resolved under Texas law.
12. NO DURESS.
I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. I further agree and acknowledge that Dallas Swim Club Royal (dba Club Royal Pool) has offered to refund any fees I have paid to use its facilities if I choose not to sign this agreement.
13. ENFORCEABILITY.
The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provisions shall be deemed not to be a part of this Agreement.
14. COUNTERPARTS AND ELECTRONIC SIGNATURES.
This Agreement may be executed in any manner of counterparts, all of which shall constitute in any number of counterparts, all of which shall constitute one and the same instrument, and any party hereto may execute this Agreement, by signing and delivering one or more counterparts. Each party agrees that this Agreement and any other documents to be delivered in connection herewith may be electronically signed, and that any electronic signatures appearing on this Agreement or such other documents are the same as handwritten signatures for the purposes of validity, enforceability, and admissibility.
I HAVE READ THIS DOCUMENT AND UNDERSTAND IT AND AM OVER THE AGE OF 18. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
